Taking Care of Lex (SPOILERS)

Ok so I'm doing the taking care of lex quest for the thieves guild, I've gotten the forged copy and I just need to seal it. There are 2 doors that will get me into the imperial offices, one has a very easy lock and takes me into what looks like barracks and has a door with a very hard lock that my journal indicates I should go through. The other door has a very hard lock and has a desk directly in front of me, but just to the right of the door is a guard who sees me when I go in. I have a sneak skill of 51, plus the shrouded dark brotherhood armor and the black band to fortify my stealth to 63 (I think), I also have a ring of 20% chameleon. How should I go about this.

A guard? The seal is on the desk, but I did it late at night and there was no guard, the room was empty.

Thanks, I tried at midnight and there was a guard there so I thought it was part of the challenge of the quest. I tried again at 11PM and no guard, no problem.
