In Morrowind I never had a guard or any other npc other than the expected residents pop in on me when I was pilfering a house or whatever. It just couldn't occur.
I was doing a quest today and I was in a house I had to break into to complete the quest. I hadn't been arrested yet and didn't plan to join the thieves guild anyway. Well, while I was in the vacant house picking up alchemy items of the kitchen table a guard appeared and arrested me. I was really surprised. Does this happen often? BTW, the guard was not stationed in the house when I entered and it wasn't a place where a guard would be welcome anyway.

Was this at night? And did you have to pick the lock on the door? If so, it's possible someone nearby saw you. That causes them to raise an alarm (which you don't see or hear), bringing around a guard, who goes to investigate.
I've broken into one house thus far, but it's much harder to do so, now. If Morrowind was like New York, Oblivion is like Switzerland. Everybody cares.

I've had this happen several times already. What does annoy me a little is that you don't actually see the guard approaching. He just materializes in front of you and your goose is very well cooked.
I had to resort to doing a Manual Save prior to breaking into houses since then.

Another new thing. When I first started the game I pilfered a couple of things from a mage guild hall. Then I found I couldn't sell the stuff, so I dropped the stuff in the same guild hall and a mage started screaming bloody murder about my stolen goods. This never could happen in New York, err, Morrowind either.

My RPG rationale is that goods are marked: armor and arms with the owner's name incised in metal, books through a knife cut into the leather cover. (Let's forget about fruit and shoes.) You bring these to a fence in order to get the identifying markers removed, just as fences do this, today--scratching out serial numbers on stolen electronic equipment, for example. If you dropped something from the Mage Guild in front of someone, they probably saw the "tag" and immediately reported it.

the worst ive found is when your just sneaking around town (as you do) and go up to someone forgetting you are still in sneak and try to talk to them. I thought id got away with that in the posh hotel in imperial city as after accusing me of being a thief she happily gave me a room for the night. of cause half way through my sleep guards barged into my room and arrested me
