I am on the PC and I do come back the following day I was just in a hurry and didn't bother to post it like that.I tried the console code it worked seeing as my main char right now is lvl 46 and I want him to finish most of the quests on Oblivion.Anyway thanks for the advice it helped.

Jauffie does the same thing on here he gets in front of me opens the cabinet but he does not go near it.He just stands near the door of the cabinet.And when I open the chest and come back to him he asks is the Amulet safe.
