I hired a monk when I was 3th level and he was 4th. Now I am at 5th level but he is still at 4th. Am I doing something wrong?

Thats exactly what will happen. Except in the beginning of the game, henchmen automatically level when you do and they always stay one level lower...

No if you have a BAB of +16(not counting Dex bonuses, or any magic bonus, or weapon focus because these wont add to # of attacks) you should have...
