Second time No deathlord spell at tomb of souls

This is the second character where the following has happened. I approach the watcher after getting Vartuggs eye and say that I want demon spell. I raid the two chests, so far its weapons and armor and then open the sarchophagus, demon pops out, kill him and get gold and dried hommonculus but NO SPELLS. I have loaded the game three times and besides the armor and weaponry changing still no deathlord spell. I am playing 1.3.
Any thoughts, hints, maybe I am missing something very obvious?

honestly, my response is don't play the 1.3 patch. Quit this character and play the 1.5 patch. The difference is night and day. You should expect these kinds of problems constantly with 1.3. There are still so many problems left after this patch that they are too numerous to elucidate. I actually unistalled DL when this patch came out and only reinstalled it when the 1.5 was released. I consider the 1.3 patch to be the worst patch I have ever encountered in gaming. Shame on Dreamcatcher.
Losing this spellbook is no big deal anyway. You lose the opp to summon a deathlord 1 time. If you need the spell recipe then check the nether spell ingredient summary off the main DL page here.

finally got it
after about three loads i finally got the spell. i will upgrade yo the collectors edition after i win with this character. i only have the maze and shaudoroth left.

I choose Demon steel instead so I can get the blade of death a nice heavy sword, plus the Angelic Destroyer and awesome heavy pole, and the Dark wing Helm. Then just mix my own summon deathlord spells.
