This was fixed in the official patch. The helmet will work properly after it is installed making it a very powerful item.

No on both accounts, Grimbold. And quite fortunatly that is. A "patch" is a small program wich overrides and replaces files that did not work quite as planned in an other program. The game works quite well without patches but a lot of frustrating minor issues are fixed by downloading and installing ...

Karembeu is right in that it's the Nishruu/Hakeshar that eats magic items. This has not been fixed in the patch, wich only fixed the fact that wands could get negative (read infinite) charges.
