Interplay vs. Bethesda, Continued

Interplay will be able to continue their work on Fallout Online for now, despite their shaky financial situation and the ongoing legal case with Bethesda, since Bethesda's request for a preliminary injuction has been denied again. Here's the summary the Vault has been able to obtain:
Motion Hearing held on 8/4/2011 [114] and [115] MOTIONS for Preliminary Injunction filed by Bethesda Softworks LLC - Argued - "DENIED" for reasons stated on the record by Chief Judge Deborah K. Chasanow. (Court Reporter: Sharon O'Neill) (td, Deputy Clerk)

Bethesda claimed as motivation for their request that the license agreement didn't extent beyond the Fallout name and that Fallout Online would "undermine the plot-line of Bethesda's awardwinning Fallout 3 game" and "harm Bethesda's reputation and that of the Fallout 3 game", making the dismissal of this request not too surprising.
