ToEE bugs make bards better than usual

I've spotted at least 2 bugs in ToEE with regards to the bard. Both of them wind up making the class even better than normal. Both bugs relate to their bard songs.

The first bug is that activating a song is supposed to be a standard action. This is listed right in the PHB bard song description. ToEE treats this as a free action, allowing you to do any other standard action along with it. This may not seem like it's a big deal, but it is, especially when you consider that you can cast a spell like Haste after you've given the whole party +2 on their rolls for free.

The second bug is that the song's effect is instantaneous. In the normal 3.5 rules, the effects occur after hearing the song for 1 full round, so usually the song isn't in effect during the often crucial 1st round. In ToEE, once the bard sings, everyone gets the benefit immediately.

Combined, these 2 bugs make the bard an even stronger character than normal. My bard is an archer, and he is able to fire his arrows with the full song bonus on the same round he begins singing. That's 2 extra shots from a magical elemental weapon that normally wouldn't occur until the following round. And the rest of the party is getting all those bonuses right away too.
