Unhappy Character Instances?

alright, hi everybody
i just started the second difficulty level and i thought to myself, "hey i should recruit a 5th party member!"

so i went to the inn to increase my party size, and run back to lothar (who i see is now a combat mage (woohoo!)
although, when i try to add him to my party this messages pops up:
"you may only have one instance of a particular character in your party at a time"
now, that's good - it makes sense and everything... except that i don't have lothar from the last difficulty in my party
i did play with him for the first half of the last difficulty level but then abandoned him for evangeline

is there a way to get rid of the old lothar for good so i can add the new lothar?

I think the game should be supposed to ask you if you want to replace the new Lothar with the other Lothar.... not sure though.
