Because your monitor is unplugged?
Because you've spilled acid on your CD?
Kinda need to give more informations for us to help you there :P, but my guess is that the patch is failing to install because your game.exe file is write protected.
Go into your Diablo 2 folder and you should find a file that hasn't got an icon, named "Game.exe" (I think it's .exe) right click it and make sure the "Read Only" option is unchecked.
If that's been done then the patch should work.
